Rights and responsibilities of the customer when reselling the vehicle

NOTICE OF AMENDMENTS TO GENERAL TERMS AND CONDITIONS OF USE AND SALE (“THE CONDITIONS”) FOR CERTAIN CONNECTED SERVICES  

Applicable to the following Brands: Peugeot, Citroën, DS Automobiles, Opel, Vauxhall 

Following amendments do not apply to Connect One, Connect Plus and Connect Premium services nor to stand alone services launched after 01 July 2023 

AMENDMENT No. 1  

The updates in this Amendment No.1 apply to the following Connected Services: 

Connected Navigation  

Telemaintenance 

Remote Control 

E-Remote Control 

Connected Alarm 

B-call/Private e-call 

 

The Conditions for the above Connected Services are hereby amended as follows: 

The following provisions shall be incorporated into the applicable Conditions for the Connected Services listed above and shall replace existing provisions on the same subject matter to the extent that they conflict with this Notice of Amendments: 

  • If the Customer decides to sell or transfer the Vehicle, terminate the rental/lease of the Vehicle, or in case of theft or scrapping/destruction of the Vehicle, Customer shall: 

- promptly notify Supplier of the same either through the Mobile Application/the Website/ by contacting the Supplier Assistance Network and/or Supplier Customer Service/Contact Centre;  

- ensure that his/her account is no longer linked to the Vehicle, by contacting the Supplier Assistance Network and/or Supplier Customer Service/Contact Centre. 

  • In the case of sale or transfer of the Vehicle - for any reason – to a third party, the Customer: 

- shall ensure that all personal data stored in the Vehicle is deleted; and 

- is required to expressly communicate to the new owner or possessor of the Vehicle the existence of the aforementioned Services. 

 

  • Should the Customer sell or transfer the Vehicle without having previously informed the new owner: (i) Supplier will not be in any way responsible for the further collection of the data, believing, in good faith, that they belong to the Customer and (ii) the Customer will remain liable pursuant to these Conditions for the proper or improper use of the Services by the new owner. 

 

  • It also remains understood that (i) Supplier is not responsible for damages deriving from violations connected to the processing of personal data in the event of failure of notification about the aforementioned circumstances and (ii) Customer will not access or use any data relating to the Vehicle following the sale or transfer to third parties and/or at the end of the rental of the Vehicle.  

 

AMENDMENT No. 2  

The updates in this Amendment No.2 apply to the following Connected Services: 

Connected Navigation 

B-call/Private e-call 

The Conditions for the above Connected Services are hereby further amended as follows: 

The following provisions shall be incorporated into the applicable Conditions for the Connected Services listed above and shall replace existing provisions on the same subject matter to the extent that they conflict with this Notice of Amendments: 

  • If the Customer decides to sell or transfer the Vehicle, terminate the rental/lease of the Vehicle, or in case of theft or scrapping/destruction of the Vehicle, the new owner of the Vehicle, within the period of validity of the Services, will be able to use the Services for the remainder of the duration of the applicable contract in which case he/she shall be deemed to be the new Customer, subject to the applicable Conditions.  

 

AMENDMENT No. 3  

The updates in this Amendment No.3  apply to the following Connected Services: 

Telemaintenance 

Remote Control 

E-Remote Control 

Connected Alarm 

The applicable Conditions for the above Connected Services are hereby further amended as follows: 

The following provisions shall be incorporated into the applicable Conditions for the applicable  Connected Services listed above and shall replace existing provisions on the same subject matter to the extent that they conflict with this Notice of Amendments: 

  • If the Customer decides to sell or transfer the Vehicle, terminate the rental/lease of the Vehicle, or in case of theft or scrapping/destruction of the Vehicle:  

 

  • the Customer shall promptly terminate the Services either through the Mobile Application/the Website/ by contacting the Supplier Assistance Network and/or Supplier Customer Service/Contact Centre;  

 

  • the new owner will be required to re-subscribe to the Services for a new duration is specified in more detail in the WEBSITE and  

 

  • No compensation or reimbursement will be due by Supplier to the Customer in the case of termination indicated in this Amendment No. 3. 

 

 

AMENDMENT No. 4  

The updates in this Amendment No.4  apply to the following Connected Services: 

Telemaintenance 

The applicable Conditions for the above Connected Services are hereby further amended as follows: 

The following provisions shall be incorporated into the applicable Conditions for the applicable  Connected Services listed above and shall replace existing provisions on the same subject matter to the extent that they conflict with this Notice of Amendments: 

  • If the Customer decides to sell or transfer the Vehicle, terminate the rental/lease of the Vehicle, or in case of theft or scrapping/destruction of the Vehicle, the new Customer will be allowed to subscribe to Telemaintenance  following the termination from the previous owner.  

 

 

AMENDMENT No. 5  

The updates in this Amendment No.5  apply to the following Connected Services: 

Remote Control 

e-Remote Control 

Connected Alarm 

The applicable Conditions for the above Connected Services are hereby further amended as follows: 

The following provisions shall be incorporated into the applicable Conditions for the applicable  Connected Services listed above and shall replace existing provisions on the same subject matter to the extent that they conflict with this Notice of Amendments: 

  • If the Customer decides to sell or transfer the Vehicle, terminate the rental/lease of the Vehicle, or in case of theft or scrapping/destruction of the Vehicle, to fully benefit from those Connected Services in the Vehicle the new owner should subscribe once they have taken delivery or  possession of the Vehicle. 

 

Defined terms and interpretation: 

In this Notice of Amendments, depending on the Connected Services concerned, references to: 

 “the Customer”  shall include  references to the relevant customer of the relevant Services as defined  in the applicable  Conditions. 

 “ the Supplier” shall include references to the relevant supplier of the relevant Services as defined in the applicable Conditions (which could, among other terms, be referred to as “the Supplier”, “the Service Provider”  the “Brand”  “PSA Automobiles SA” or  “the Manufacturer”). PSA Automobiles SA has  changed its name to Stellantis Auto SAS as from 1 November 2023. 

 “the Vehicle”  shall be references to the Vehicle as defined in the applicable  Conditions for the applicable Services. 

 “Mobile Application” shall be references to the mobile application to which the Customer may subscribe as set out in the applicable  Conditions (which could be variously referred to as “MyPeugeot App” or “Application” ) 

“Website” shall be references to the Vehicle brand connected services website as set out in the applicable  Conditions (which could be variously referred to as “Peugeot Connect Store” or “Peugeot Services Store” ) 

“Services” shall be references to the applicable Connected Services as defined in the applicable Conditions  

“Supplier Assistance Network" means  retailers authorised by the Supplier to sell or service Vehicles or any other person authorised by the Supplier to provide assistance services.
